Agreement to Our Legal Terms

We are PT Olah Limbah Owaste, doing business as OWaste (“Company,” “we,” “us,” “our”), a company registered in Indonesia at Jl. Telekomunikasi No.1, Bandung, Jawa Barat 40257. We operate the mobile application OWaste (the “App”), as well as any other related products and services that refer or link to these legal terms (the “Legal Terms”) (collectively, the “Services”).

O’Waste is a waste-management and circular-economy solutions company that helps businesses and communities reduce landfill by collecting, sorting, and recycling waste, turning it into useful resources, with data reporting, education, and compliance support.

These Legal Terms constitute a legally binding agreement between you and PT Olah Limbah Owaste concerning your access to and use of the Services. By accessing the Services, you agree to be bound by these Legal Terms. If you do not agree, you must discontinue use immediately.

Supplemental terms and documents may be posted on the Services from time to time and are expressly incorporated. We may modify these Legal Terms at any time by updating the “Last updated” date. Your continued use after posting constitutes acceptance. The Services are intended for users at least 13 years of age; minors must have parental permission and supervision.

1. Our Services

This section summarizes the Privacy Policy highlights regarding what information we collect, how we use it, sharing, security, changes, miscellaneous, and acknowledgment/consent.

• Information We Collect: name, email, phone, password during registration; Points (e-wallet) balance and related transaction history.
• How We Use the Information: account verification, communications, notifications; operate wallet features; analyze usage in aggregate to improve services.
• Sharing: no sale or rent of Personal Information; disclosures as required by law or in disputes; minimal sharing with service providers (e.g., OTP, email, Points) under confidentiality.
• Security: reasonable measures (e.g., hashed passwords, restricted access) but no absolute guarantee; transmit at your own risk; keep your password confidential.
• Changes: updates may occur; material changes notified by email or in-app at least 1 day prior; review periodically.
• Miscellaneous: Indonesian version may prevail; governed by the laws of the Republic of Indonesia; disputes resolved first by deliberation.
• Acknowledgment & Consent: by using services, you agree to the Privacy Policy and represent you have the right to share the information provided.

2. Intellectual Property Rights

We own or license all intellectual property in the Services (source code, databases, software, designs, text, media, etc.) and the trademarks / service marks / logos (“Marks”). Content and Marks are protected by law and provided “AS IS” for personal or internal business use.

Subject to compliance with these Legal Terms, we grant a non-exclusive, non-transferable, revocable license to access the Services and download/print Content you have properly accessed for permitted use. Any other use requires prior written permission. We reserve all rights not expressly granted.

Your Submissions & Contributions: Submissions assign IP rights to us; Contributions grant us a broad license to use and distribute your content, including your name and likeness, as detailed in the original terms.

3. User Representations

By using the Services, you represent information you submit is accurate and current; you have legal capacity and comply with these Legal Terms; you are 13+; you will not use automated means; you will not use the Services for illegal purposes; and your use complies with applicable law.

4. User Registration

Registration may be required. Keep passwords confidential. We may remove or change usernames deemed inappropriate.

5. Purchases and Payment

Payments are processed through channels provided by Xendit Payment Gateway. You must keep purchase and account information current. Prices may change; all payments in Rupiah. We may refuse, limit, or cancel orders at our discretion, including those appearing to be placed by resellers or distributors.

6. Policy

All sales are final and non-refundable.

7. Prohibited Activities

Includes scraping/compiling content without permission, attempting to gain sensitive info, interfering with security features, disparaging or harming the Services, harassment, illegal use, unauthorized linking/framing, uploading malware/spam, automated use, impersonation, reverse engineering beyond permitted by law, using buying agents, collecting emails for unsolicited messages, competing use, advertising goods/services, and selling/transferring your profile, among others described in the original terms.

8. User Generated Contributions

Contributions must not infringe rights, must be lawful, accurate, non-abusive, non-discriminatory, and comply with these Legal Terms. Violations may result in termination or suspension.

9. Contribution License

By posting, you grant us a worldwide, perpetual, royalty-free license to use, reproduce, display, distribute, and create derivative works from your Contributions in any media, and to sublicense. You retain ownership of your Contributions; we may edit, re-categorize, pre-screen, or delete content at our discretion.

10. Guidelines for Reviews

Reviews require firsthand experience, must not contain profanity, discrimination, references to illegal activity, or false/misleading statements, and you must not be affiliated with competitors when posting negative reviews. We may accept, reject, or remove reviews at our discretion.

11. Mobile Application License

We grant a limited license to install and use the App on your devices per these terms. Additional terms for Apple App Store and Google Play apply; App Distributors are third-party beneficiaries for enforcement of these terms.

12. Social Media

You may link Third-Party Accounts; you warrant the right to disclose and grant access. Depending on privacy settings, content from such accounts may be available through the Services. You may disable connections; we will attempt to delete obtained information, except username and profile picture associated with your account.

13. Third-Party Websites and Content

We are not responsible for Third-Party Websites or Content, and inclusion does not imply endorsement. You access such content at your own risk and should review their policies. Purchases via Third-Party Websites are solely between you and the third party.

14. Advertisers

We may display advertisements; we only provide space and have no other relationship with advertisers.

15. Services Management

We may monitor violations, take legal action, restrict or disable content, remove excessive/burdensome files, and manage the Services to protect rights and ensure proper function.

16. Copyright Infringements

If you believe content infringes your copyright, notify us. Making material misrepresentations may result in liability.

17. Term and Termination

These terms remain in effect while you use the Services. We may deny access, terminate accounts, and delete content at any time for any reason. If terminated, you may not create a new account. We may pursue legal remedies.

18. Modifications and Interruptions

We may change or remove content and are not obligated to update information. Availability is not guaranteed; downtime may occur. We have no obligation to maintain or support the Services.

19. Governing Law

These Legal Terms are governed by the laws of Indonesia; courts of Indonesia have exclusive jurisdiction.

20. Dispute Resolution

Informal Negotiations

Parties agree to negotiate any Dispute for at least 30 days before arbitration.

Binding Arbitration

Disputes shall be finally resolved by the International Commercial Arbitration Court under the European Arbitration Chamber. Seat: Bandung, Indonesia. Language: Indonesian. Governing law: Indonesian substantive law. Three arbitrators.

Restrictions

No class arbitrations or representative actions.

Exceptions

IP rights, theft/piracy/privacy/unauthorized use, and injunctive relief claims are excluded from informal negotiation/arbitration. If unenforceable, such Disputes go to a competent court per jurisdiction above.

21. Corrections

We may correct errors or update information on the Services at any time without prior notice.

22. Disclaimer

The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind to the fullest extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant accuracy, security, availability, or that defects will be corrected.

23. Limitations of Liability

We will not be liable for any indirect, consequential, incidental, special, or punitive damages, including lost profit, revenue, or data, arising from your use of the Services, even if advised of the possibility.

24. Indemnification

You agree to defend, indemnify, and hold us harmless from claims arising out of your Contributions, use of the Services, breach of these Legal Terms, infringement of rights, or harmful acts toward other users. We may assume exclusive defense and control.

25. User Data

We maintain certain data to manage performance. You are responsible for all data you transmit or related to your activities. We have no liability for loss or corruption of such data.

26. Electronic Communications, Transactions, and Signatures

You consent to electronic communications and records. You agree to electronic signatures, contracts, orders, and delivery of notices, policies, and records of transactions by us or via the Services.

27. Miscellaneous

These Legal Terms and posted policies constitute the entire agreement. Failure to enforce is not a waiver. We may assign rights and obligations. If a provision is unlawful or unenforceable, it is severable. No partnership/agency is created. These terms are not construed against the drafter. You waive defenses based on electronic form and lack of signatures.
